The Economic and Financial Crimes Commission (EFCC) has said it would appeal the order of a federal high court that it should defrost the accounts of Ekiti state governor Ayodele Fayose.
News Agency of Nigeria reports that the EFCC vowed on Tuesday, December 13, after the order was issued that it would contest it.
EFCC spokesperson, Wilson Uwujaren confirmed the commission’s position, noting that it had made necessary moves for the appeal.
Uwujaren said:
The EFCC has been drawn to the order by Justice Taiwo Taiwo of the Federal High Court, Ado Ekiti, Ekiti, state asking it to defreeze the accounts of Governor Ayo Fayose in Zenith Bank.
While the commission awaits the certified copy of the ruling, it is important to point out that this order contradicts another order by Justice M. B Idris of the Federal High Court, Lagos.
The first order gave the commission the nod to freeze the accounts pending the conclusion of investigation.
This order from a court of coordinate jurisdiction was not set aside by Justice Taiwo.
In spite of this, the commission has taken immediate steps to appeal against the order by Justice Taiwo.
Recall that about 5 months ago, the EFCC froze Ayodele Fayose's personal accounts while it investigated issues of money laundering and the Ekiti election fraud saga.
However, Justice Taiwo of the Federal high court in Ekiti state ordered on Tuesday that the EFCC should defrost the accounts because its actions did not follow due process.
